Fygo Seek Terms of Service
Main terms version 1.1
Updated Date: 13/10/2026 Effective Date: 13/10/2026Welcome to Fygo Seek!
These Fygo Seek Terms of Service (this "Agreement" or the "Terms") are entered into between you, whether an individual or a legal entity (the "User" or "you"), and AXISSTORE TECHNOLOGY PTE. LTD. ("Fygo", "we", "us" or "our") for the licence and related services of Fygo Seek ("Seek"). Seek and its covered features and services are collectively the "Software" or the "Services". Seek is a standalone product designed to run with compatible FygoOS software on your NAS; these Terms do not replace the separate terms for FygoOS, hardware or another Fygo product.
IMPORTANT NOTICE:We hereby specifically remind you that, in order to use this Service, you must read and understand these Terms, especially provisions concerning eligibility, payments, user content, restrictions, suspension, disclaimers, liability and dispute resolution. Unless you read and accept all applicable terms, you may not use Seek or its related Services. Where you accept these Terms for an organization, you represent that you are authorized to bind it.
You must meet the legal-capacity and adult eligibility conditions in Scope and Eligibility below. Where you accept this Agreement on behalf of an organization, you represent that you are authorized to bind it.
By clicking to accept when these Terms are presented, you agree to be bound by them. Where applicable law permits acceptance by conduct, use after a clear opportunity to review the Terms may also constitute acceptance. This does not replace any separate express consent required by law for a subscription, privacy choice or other matter. Questions may be sent to [email protected].
1. Scope and Eligibility
This Agreement consists of: (a) these Terms and (b) any additional usage terms expressly identified to you as applying to a particular plan or service feature.
1.2 The commercial specifics of any paid plan, including plan name, price, currency, billing cycle, any free trial and its duration, included quotas or limits, and any promotional conditions, are those displayed on the Purchase Page at the time you place your order. The Purchase Page information is confirmed to you in the order confirmation and constitutes the record of what you have purchased.
1.3 The general rules for purchasing, paying for, renewing, upgrading, downgrading, cancelling and obtaining refunds for paid plans are set out in the Fygo Subscription Agreement.
1.4 The Purchase Page information and the Subscription Agreement are not incorporated into this Agreement and their content is not restated here. This Agreement governs your use of Seek; the Purchase Page information and the Subscription Agreement together govern the commercial relationship for a paid plan. Where these Terms or a Schedule describe a plan, that description is functional only; if it differs from the Purchase Page information for the plan you purchased, the Purchase Page information determines your commercial entitlements.
1.5 Within this Agreement, a Schedule prevails over conflicting provisions of these Terms solely for the subject matter covered by that Schedule, and additional plan or feature terms under clause 1.1(b) prevail over these Terms solely for the plan or feature they describe. Mandatory applicable law prevails in all circumstances.
1.6 The Fygo Seek Privacy Notice and its Jurisdiction-Specific Addenda describe how personal data is processed in connection with Seek. They are provided for your information, do not form part of this Agreement, and cannot be modified or overridden by any provision of this Agreement.
1.7 FygoOS, your NAS hardware, your Fygo Account and any third-party services you use together with Seek are governed by their own applicable terms. This Agreement does not modify those terms.
2. Legal Capacity
By accepting this Agreement, you confirm that you are at least 18 years old or the age of majority in your jurisdiction, whichever is higher, and have the legal capacity to enter into it. If you accept on behalf of a legal entity or other organization, you confirm that you are authorized to bind that organization, and references to "you" include it.
3. Modification and Update of the Agreement
We may update these Terms for changes in law, security requirements, supported technology or Seek. Each document or schedule identifies its version and effective date. A change limited to one service may update only its schedule; common changes will be reflected in the affected common provisions. We provide reasonable advance notice of material changes, explain their effect and obtain acceptance where required. Changes do not retrospectively remove accrued rights or reduce prepaid entitlements contrary to law. Where required, you may reject a material adverse change, terminate the affected service and receive the applicable remedy. Urgent legal or security changes may take effect sooner where permitted, with notice as soon as practicable.
4. Scope of the Services
Depending on the version and plan made available to you, Seek may provide media and project organization, filtering and search, smart folders, team workspaces, previews and transcoding, review comments and annotations, local AI search, review export and review-sharing links. A description applies only where the corresponding function is available in your version and enabled or used by you. It is not a promise to release or indefinitely maintain a future function.
You need compatible NAS hardware, compatible FygoOS software, a supported browser or client, network connectivity and the account, permissions and licence required for the selected function. Performance and availability may depend on NAS resources, media format, network route, recipient device, geographic location and plan limits disclosed before activation or purchase.
5. Accounts Teams and Permissions
5.1 Fygo Account. A Fygo Account is used to activate your Licence and, where applicable, by Recipients to sign in to comment. You must provide accurate information for your Fygo Account, keep your credentials confidential and promptly notify us at [email protected] if you suspect unauthorised access to your Fygo Account. We may require reasonable verification before acting on a request relating to a Fygo Account or where we consider it necessary to protect that account.
5.2 Access to Seek on your NAS. Seek runs on your NAS. Who can sign in to Seek on your NAS, and what they can do, is determined by the user accounts and settings you configure on your NAS through FygoOS. These are under your control. Fygo does not operate the user accounts on your NAS and cannot reset credentials, recover access or restrict access to Seek on your NAS. If you suspect unauthorised access to Seek on your NAS, you should act through your NAS and FygoOS administration tools.
5.3 Persons you allow to use Seek. If you are an organisation, or if you allow other persons to use Seek on your NAS, you are responsible for deciding who may access Seek and your Projects, for configuring their access appropriately, and for ensuring that they comply with this Agreement. Seek does not provide role-based or project-level permission management between users of the same NAS; you should not rely on Seek to restrict what one user of your NAS can see or do in relation to another user's Projects.
5.4 No sharing or circumvention. Credentials are personal to the individual to whom they are issued. You may not share an individual credential, allow Seek to be used beyond the limits of your plan, or otherwise circumvent the limits applicable to your plan under Schedule S1 and the Purchase Page.
5.5 Recipients. A Recipient who accesses content through a Review Sharing Link obtains access only to the assets, and only with the permissions, validity period and password protection (if any), set by the Sharer for that link, whether or not the Recipient has signed in with a Fygo Account. A Recipient does not thereby obtain access to Seek on your NAS or to any other Project.
5.6 Responsibility. To the extent permitted by applicable law: (a) you are responsible for activity conducted through your Fygo Account and through Seek on your NAS, including activity of persons you allow to use Seek under clause 5.3; and (b) you bear losses arising from your failure to keep credentials confidential or from your intentional sharing of credentials. Nothing in this clause makes you responsible for activity caused by Fygo's breach of this Agreement, a security defect in Seek within Fygo's control, or any other matter for which applicable law makes Fygo responsible.
6. Feature Updates and Compatibility
We may update Seek to address security issues, comply with law, maintain compatibility or improve operation. We provide information about material changes and updates required by law or the agreed service. Declining a necessary update may affect compatibility or security. We do not guarantee indefinite support for every older release, subject to mandatory update and conformity obligations.
7. Plans, Purchases and Subscription Terms
7.1 Plans. Seek is offered under the plans described on the Purchase Page. The features, limits, licence term, NAS or device binding, support level and trial conditions of each plan are those stated on the Purchase Page at the time of your order or activation. A plan name alone does not confer any entitlement not stated there.
7.2 Purchases and subscriptions. Pricing, taxes, payment methods, the seller of record, billing, trials, renewal, cancellation, price changes, refunds, withdrawal rights and payment failure are governed by the Subscription Terms and the disclosures made to you on the Purchase Page at the time of your order, and not by this Agreement. You will be shown the Subscription Terms and those disclosures before you place an order. Payment may be processed by a payment provider under its own terms.
7.3 Order of precedence. If there is a conflict between the documents that apply to your use of Seek, they take precedence in the following order, except where mandatory law provides otherwise: (a) the disclosures made to you on the Purchase Page for a specific order, as regards that order; (b) the Subscription Terms, as regards the matters listed in clause 6.2; and (c) this Agreement. The Seek Privacy Notice governs the processing of personal data and is not subordinate to this Agreement.
7.4 Effect of expiry on your content. When a paid entitlement ends, whether by expiry, cancellation or otherwise, the corresponding paid functions of Seek will cease. This does not itself delete Projects, assets, review information or configuration already stored on your NAS. Before a paid function ends, you should use the available controls to export or back up any information you need, as some functions for viewing or exporting that information may themselves be paid functions.
8. License Limitations
8.1 Limited Use
Subject to these Terms, the applicable order and payment of any required fee, Fygo grants you a limited, non-exclusive, non-transferable non-sublicensable licence and revocable licence during the applicable term to enable and use Seek functionally within compatible FygoOS systems for your personal, professional or internal business purposes within the purchased plan and user limits.
8.2 Restrictions and Reservation of Rights
Except where applicable law or an applicable open-source licence expressly permits it, you must not copy or redistribute Seek beyond the permitted installations; sell, rent, lease or sublicense it; reverse engineer, decompile or disassemble it; circumvent security or plan controls; remove proprietary notices; use it to build or publish a benchmark of a competing service without permission; or use Fygo's trademarks without written authorization. Fygo and its licensors retain all rights in Seek, its interface, documentation, software, models supplied by Fygo and other Fygo materials. Open-source components remain governed by their applicable licences.
8.3 Seek is an integrated component designed to operate together with compatible FygoOS on your NAS. You may use Seek functionality as intended within FygoOS. You must not separate, extract or redistribute individual components of Seek contrary to this licence, save as permitted by applicable law or open‑source licence terms.
8.4 Any commercial resale, pre‑installation, bundling or other commercial exploitation of Seek outside the scope of your purchased plan requires Fygo’s prior written authorization.
9. User Obligations and Prohibited Conduct
9.1 General. You must comply with applicable law when using Seek. Seek runs on your NAS and Fygo does not review, moderate or have general access to the content you store in Seek. You are responsible for that content, for the Projects you create and for what you choose to share through Review Sharing Links.
9.2 Content you store and share. You must have the rights needed to store, process and share the assets you place in Seek. In particular, you must not use Seek to:
(a) store, process or share content that infringes copyright, trade mark, trade secret, privacy, publicity or other rights of any person;
(b) share, through a Review Sharing Link or otherwise, footage, images or audio of identifiable individuals unless you have a lawful basis to do so, having regard to the persons shown, the context in which the material was recorded and where it will be received;
(c) store or share content that is unlawful in the jurisdiction where you or the intended Recipient is located, including content that facilitates fraud, exploitation of minors, incitement or harassment; or
(d) share content with a Recipient in breach of a confidentiality obligation you owe to a third party, including a client or production for which the material was created.
9.3 Review Sharing Links. Review Sharing Links are designed for review of specific assets by a limited number of Recipients. You must not:
(a) use Review Sharing Links as a general means of publishing, hosting or distributing files to the public or to an unrestricted audience;
(b) use Review Sharing Links to deliver or relay content in volumes or patterns that exceed the limits stated on the Purchase Page or that are inconsistent with review use, or otherwise use the infrastructure Fygo operates for Review Sharing Links in a way that degrades the service for other users;
(c) send a Review Sharing Link to a person whom you know or reasonably suspect intends to use it in breach of this Agreement;
(d) disable, weaken or circumvent the password, validity period, permission or other controls applying to a Review Sharing Link, or assist any person to do so; or
(e) share a Review Sharing Link with anyone other than the intended Recipients where you have set a password or permission on the basis that access will be limited.
You are responsible for choosing appropriate settings for each Review Sharing Link and for revoking a link when it is no longer needed or where you become aware of misuse.
9.4 Comments and review activity. You must not, and must not permit Recipients you invite to, post comments, annotations or other review content that is defamatory, harassing, threatening, discriminatory or otherwise unlawful, or that contains malware, unsolicited advertising or material unrelated to the review. Where a Recipient posts such content, you should remove it or revoke the relevant Review Sharing Link using the controls available to you.
9.5 Security and integrity. You must not:
(a) access or attempt to access any Fygo Account, NAS, Project, Review Sharing Link, server or data without authorisation;
(b) interfere with the security, integrity, availability or performance of Seek, of the infrastructure Fygo operates in connection with Seek, or of any other system;
(c) introduce malware or other harmful code into Seek or any content shared through it;
(d) probe, scan or test the vulnerability of Seek or Fygo's infrastructure, or carry out automated scraping or bulk requests, without Fygo's prior written authorisation; or
(e) use Seek to conduct any of the foregoing against a third party.
9.6 Licence and technical restrictions. You must not:
(a) circumvent, disable or interfere with licence activation, NAS or device binding, Fygo Account authentication, plan limits or other technical measures that control access to or use of Seek;
(b) modify, adapt, translate, decompile, disassemble or reverse engineer Seek, or create derivative works of it, except to the extent that applicable law expressly permits this notwithstanding a contractual restriction;
(c) copy, redistribute, sell, rent, lease, sublicense or otherwise make Seek available to any third party, other than as expressly permitted by this Agreement;
(d) remove, obscure or alter any copyright, trade mark or other proprietary notice contained in Seek.
9.7 Use of Fygo's name. You must not identify or refer to Fygo or Seek in any manner that could reasonably imply that Fygo endorses, sponsors or is affiliated with you, your content or your Projects, without Fygo's prior express written consent. This does not prevent you from factually stating that you use Seek.
9.8 Official channels. You must obtain Seek only through an official channel designated by Fygo, including FygoOS. Software obtained through another source may be modified or malicious. To the extent permitted by law, Fygo is not responsible for software that it did not distribute or authorise, and this Agreement does not license such software.
9.9 Consequences. A breach of this clause 9 is a material breach of this Agreement. Without limiting clause 14.4 (Suspension and Termination), where a Review Sharing Link is being used in breach of this clause and the link relies on infrastructure operated by Fygo, Fygo may disable that link and, where practicable, will notify you. Fygo cannot and will not act on content stored solely on your NAS.
10. Data and Privacy
We attach great importance to users' personal information and privacy security. When you use our Services, we will collect, store, use, transmit and protect your personal information in accordance with applicable laws and regulations. For full details and specific agreements regarding the types of information we collect, how we use such information, the scope of information sharing, the retention period of information, your rights related to personal information, as well as security measures and all other privacy-related matters, please fully review our separate Privacy Notice. The Privacy Notice constitutes an integral part of this User Agreement and has the same legal effect as this User Agreement.
11. Intellectual Property
11.1 Fygo Materials
As between you and Fygo, all rights, title and interest in Seek and the Service, including its software, interfaces, documentation, models supplied by Fygo, trademarks and other materials provided by Fygo (collectively, the "Fygo Materials"), are owned by Fygo or licensed to it and protected by applicable intellectual-property laws. The Fygo Materials do not include User Content. Except for the limited licence expressly granted, no rights are granted by implication or otherwise.
11.2 Your Content
As between you and Fygo, you retain rights in media, project data, reviews and other content you provide or control through Seek ("User Content"). You grant Fygo only a limited, non-exclusive, worldwide and royalty-free permission for the time and scope necessary to provide the functions you request, such as authenticating access, activating a licence, processing a support submission and forwarding encrypted content through an enabled relay.
This permission does not authorize Fygo to sell your content, use it for advertising, train a hosted model on it or maintain an independent cloud-content library. Local operations by software on your NAS do not transfer ownership to Fygo. You represent that you have the rights and permissions necessary for your content and instructions.
11.3 Rights Notices
If you believe content or a Seek sharing link infringes your rights, contact [email protected] with your contact details, identification of the right, sufficient information to locate the material and a statement supporting your claim. We may disable a link or take another proportionate action within our technical and legal control. We cannot read or delete a file held only on a NAS to which we have no access. A knowingly false or misleading notice may expose the sender to liability under applicable law.
Upon receipt of a valid notice, we may disable a sharing link or take other proportionate action within our technical and legal control. We will forward the valid infringement notice to the user who made the relevant content available. That user may submit a counter‑notice containing preliminary evidence of non‑infringement. We may restore the relevant link or feature upon receipt of a complete counter‑notice in accordance with applicable law. A knowingly false or misleading notice or counter‑notice may expose the sender to liability under applicable law.
12. Disclaimer and Limitation of Liability
12.1 Service Availability and Warranties
NOTHING IN THESE TERMS EXCLUDES, RESTRICTS OR MODIFIES A STATUTORY GUARANTEE, WARRANTY, RIGHT OR REMEDY THAT CANNOT LAWFULLY BE EXCLUDED. EXCEPT FOR EXPRESS PROMISES IN THESE TERMS OR AN APPLICABLE ORDER, AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEEK IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DO NOT WARRANT THAT EVERY MEDIA FORMAT, DEVICE OR NETWORK CONFIGURATION WILL BE COMPATIBLE, THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT LOCAL AI RESULTS WILL BE ACCURATE. THESE DISCLAIMERS DO NOT APPLY TO THE EXTENT A FAILURE RESULTS FROM FYGO'S BREACH OR FAULT OR A WARRANTY CANNOT LAWFULLY BE EXCLUDED.LOCAL AI SEARCH RESULTS MAY BE INCOMPLETE OR INACCURATE; FYGO DOES NOT WARRANT THE COMPLETENESS OR ACCURACY OF LOCAL AI OUTPUT.FYGO ACTS ONLY AS AN ENCRYPTED TECHNICAL RELAY UNDER FYGO CONNECT MODE AND DOES NOT TAKE CUSTODY OF YOUR MEDIA ASSETS. RISKS ARISING FROM IMPROPER LINK‑PERMISSION CONFIGURATION SHALL BE BORNE BY YOU.
12.2 Local Systems and Backups
The Service relies on the internet, your NAS, local network, power supply, storage media and other infrastructure outside Fygo's control. Storage media and local systems may fail. You should maintain independent backups. Fygo does not provide a cloud backup or guaranteed data-recovery service for Seek content. Any recovery assistance is best-effort unless an order expressly states otherwise.
12.3 FORCE MAJEURE
NEITHER PARTY SHALL BE LIABLE FOR ANY FAILURE OR DELAY IN PERFORMING ITS OBLIGATIONS UNDER THIS AGREEMENT TO THE EXTENT CAUSED BY EVENTS BEYOND ITS REASONABLE CONTROL THAT ARE UNFORESEEABLE, UNAVOIDABLE AND INSURMOUNTABLE, INCLUDING NATURAL DISASTERS, EPIDEMICS, WAR, TERRORISM, RIOTS, GOVERNMENTAL ACTIONS, CHANGES IN LAW, STRIKES, AND WIDESPREAD FAILURES OF PUBLIC UTILITIES OR TELECOMMUNICATIONS NETWORKS (“FORCE MAJEURE”). THE AFFECTED PARTY SHALL NOTIFY THE OTHER PARTY WITHIN A REASONABLE TIME AND USE REASONABLE EFFORTS TO MITIGATE THE EFFECTS. FORCE MAJEURE SHALL NOT EXCUSE ANY FAILURE CAUSED BY A PARTY’S OWN NEGLIGENCE OR ANY PAYMENT OBLIGATION (IF ANY).
12.4 Third‑Party Materials.
Seek running under FygoOS may permit you to connect to third‑party services, plug‑ins or content (“Third‑Party Materials”). Third‑Party Materials are governed by their providers’ own terms and privacy policies. We do not control, endorse or assume responsibility for Third‑Party Materials. To the maximum extent permitted by applicable law, we shall not be liable for any loss arising from your installation or use of them.
12.5 Exclusion and Cap
To the maximum extent permitted by applicable law, Fygo and its affiliates, licensors and suppliers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, business, goodwill or anticipated savings, arising from Seek. This exclusion does not apply where such damages cannot lawfully be excluded.
To the maximum extent permitted by law, the aggregate liability of Fygo and those parties arising out of or relating to Seek or these Terms will not exceed the greater of the amount you paid for Seek during the 12 months immediately before the event giving rise to the claim and USD 100 or its equivalent in local currency.
Nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, willful misconduct or gross negligence, or any other liability or consumer remedy that cannot lawfully be excluded or limited.
For the avoidance of doubt, this aggregate‑liability cap does not apply to hardware warranty claims for your underlying NAS hardware, which are governed by separate hardware warranty documentation.
13. U.S. Special Terms
You represent and warrant that you are not located in, owned or controlled by, or listed on any United Nations, United States, Singapore or other applicable sanctioned‑party list.
13.1 Export Restrictions
You must comply with export-control, sanctions and trade laws that apply to Seek or your use. You must not export, re-export, provide or use Seek in a prohibited country, for a prohibited end user or for a prohibited end use. Encryption and authentication functions may be subject to local import or export rules.
13.2 U.S. Government Restricted Rights
If Seek or its documentation is acquired for or on behalf of the U.S. Government, it is a commercial product consisting of commercial computer software and commercial computer-software documentation and is licensed only with the rights granted to other end users under these Terms. Unpublished rights are reserved under U.S. copyright law.
14. Liability for Breach
14.1 Enforcement Measures
If we reasonably believe you materially breached these Terms or applicable law, we may act diligently and proportionately by warning you; disabling a link or content within our control; restricting the affected account, licence or function; suspending or terminating the affected Service; or reporting a matter where legally required or reasonably appropriate.
14.2 Notice Reasons and Right to Contest
Before suspension or termination, we give prior warning and a reasonable opportunity to remedy where appropriate, except where a breach is serious or cannot be remedied, urgent action is necessary to prevent harm, or notice is prohibited by law. We provide the measure, reasons and a method to contest it unless prohibited. You may contest at [email protected] within 30 days of notice, and we will conduct a timely, non-discriminatory and non-arbitrary review.
14.3 Your Responsibility
You are responsible for losses Fygo suffers as a direct result of your breach of these Terms or applicable law. If you use Seek in a trade, business or profession, you will indemnify Fygo against third-party claims, losses and reasonable legal costs arising from your unlawful content or material breach, but only to the extent legally recoverable from you and attributable to your conduct. This paragraph does not apply to a consumer to the extent prohibited by law.
14.4 Suspension and Termination
You may stop using Seek at any time. Account deletion, cancellation of renewal, expiry of a licence, NAS unbinding, removal of a member, ending a sharing link and deletion of local content are separate actions and may have different effects.
Fygo may suspend or restrict the affected account, licence, link or Service where reasonably necessary to address a material breach, fraud, unauthorized use, a security risk, non-payment after notice, a lawful order or a legal obligation. We act proportionately and provide notice, reasons and a reasonable opportunity to remedy where appropriate, unless the breach cannot be remedied, urgent action is required to prevent harm or notice is prohibited by law.
Fygo may terminate an affected Service or licence by written notice if the term expires without renewal, a material breach cannot be remedied, a remediable breach is not cured within 14 days after notice, payment remains overdue for more than seven days after notice, or termination is required by law. Mandatory consumer rights and remedies remain unaffected.
Expiry or termination does not itself delete media already stored on your NAS unless the interface expressly identifies that result and you confirm it. Licences for the terminated Service end, but rights in your own content and separate valid FygoOS or hardware rights do not thereby end. Fygo-held personal information is retained or deleted under the Seek Privacy Notice.
14.5 Survival
Termination or expiry of this Agreement shall not affect any rights, remedies, obligations or liabilities of either party accrued before termination, including indemnification, intellectual‑property rights, confidentiality obligations and claims arising out of prior breach. Those provisions intended by their nature to survive termination shall remain in full force and effect.
15. Governing Law and Dispute Resolution
15.1 These Terms are governed by the laws of Singapore, without regard to conflict-of-law rules. If you are a consumer, this choice does not deprive you of mandatory protections of the law that would otherwise apply to you, including protections of your country of habitual residence.
15.2 To the extent enforceable against you, a dispute arising out of or relating to these Terms, including their existence, validity, interpretation, performance, breach or termination, will be finally resolved by arbitration administered by the Singapore International Arbitration Centre under its rules then in force. The seat is Singapore, the tribunal consists of one arbitrator and the language is English. This clause does not prevent a consumer from using a court or forum that cannot validly be excluded, seeking urgent interim relief, using a mandatory dispute-resolution process or complaining to a competent regulator. Any separate consent to arbitration required by law will be obtained.
15.3 Before commencing any arbitration or court proceedings, you agree to first contact us at [email protected] and allow us a period of at least sixty (60) days to attempt to resolve the dispute informally through amicable negotiations. This period shall not apply where urgent injunctive or interim relief is sought, a regulatory complaint is filed or use of a mandatory consumer‑redress process is required by applicable law.
16. Other Provisions
16.1 Assignment
You may not assign these Terms or transfer a licence except with Fygo's written consent or where applicable law gives you that right. Fygo may assign these Terms as part of a merger, reorganization or sale of the relevant business, provided the assignment does not reduce mandatory rights and required notice is given.
16.2 Severability and Waiver
If a provision is invalid or unenforceable in a jurisdiction, it will be limited or severed only to the extent necessary there, and the remaining provisions continue in effect. A failure to enforce a provision is not a waiver.
16.3 Entire Agreement and Order of Precedence
These Terms, the applicable order, Subscription Terms presented for an automatically renewing offer and any additional terms expressly presented before a plan is activated constitute the agreement for Seek. Offer details prevail as to the purchased product, price and committed term. Subscription Terms govern subscription-specific billing, renewal, trial, cancellation and chargeback matters. The Seek Privacy Notice governs personal-information processing. FygoOS, hardware and third-party products remain subject to their own applicable terms. Mandatory law prevails in all cases.
16.4 Notices
We may give service notices through Seek, the account interface, email or the relevant website. Legal notices to Fygo must be sent to [email protected] and, where required, to the postal address below. You are responsible for maintaining an accurate contact address for your account.
16.5 Language
These Terms are prepared in English. If we provide a translation, the English version prevails in the event of inconsistency, except where applicable law requires another version to govern or protects a consumer's reliance on the version presented.
